James Greene was arrested after he hit the side of a moving pickup truck while on his motorized wheelchair. Police arrived on the scene and determined he was impaired by alcohol and drugs, and was convicted of drunken driving.
Naturally, the Waldort, Oregon man appealed the ruling. He argued that despite the fact he was riding a motorized vehicle, he should be treated as a pedestrian. The court agreed and his DUI charge was overturned.
